In general, my rule of thumb is do unto others.  I will treat / collect your data as I expect my data to be treated / collected.  In one word:  minimally.

I want you to be comfortable.  I will be as transparent as I can be and where I can’t, we’ll engage experts as needed.  Your data is money for a lot of companies.  For me it’s a tool to connect with you, and only that.  I have vendors to help me along the way.  They’re listed below.  If you have any concerns with those below, please talk to me.

California, EU, UK, and Switzerland: All privacy policy terms are set forth in a way to be compliant with your specific applicable requirements.  No data collected for or by JAM’D is “sold” and thus no option to “opt out”.  No user of JAM’D will be discriminated against for data-related issues or as a human, regardless of location.  Please contact JAM’D directly if there are concerns.

The Basics

I am Jess Murphy.  I am the founder and owner of JA Murphy Designs LLC, and the business, JA Murphy Consulting LLC®. I am physically located in Rochester, NY, working both locally and remotely on design, art, and gift-related projects (“I”, “me”, “my”, and “JAM’D”). 

I reserve the right to update this privacy policy from time to time, which will be reflected by the version date at the top of this page.  All updates / amendments will be in effect immediately upon notice, which will be given on the JAM’D site.

Key Terms

Subscriber” is a person who has provided an email, first, and / or last name to subscribe to regular JAM’D update email campaigns. The Squarespace privacy policy around “Contact” applies to all SubscribersYou will be subject to the SquareSpace privacy policy, which can be found here.

Visitor” is a person who has visited the JAM’D website.  This includes consuming content within the blog or JAM’D copyrighted ePapers, which do not require a subscription.  This does not include any links external to the JAM’D website (e.g., links embedded as references or referrals).  You will be subject to the SquareSpace privacy policy, which can be found here.

Contact” is an entity who has started a personalized connection or communication as a prospective client or has participated in free consultation services. 

Client” is an entity who has signed appropriate service agreements and has entered a contract-bound relationship with JAM’D’s consulting services.  To review terms and conditions for all service contracts, please visit jessica-murphy.com/t-c.

“you” and “your” means, depending on the context, one of the above.

Information you provide:

As a Subscriber, by opting into email campaigns powered by Squarespace, you may provide information as outlined below:

  • Contact information (name and email)

  • Marketing information (regarding your contact preferences) 

As a Visitor, by consuming information on the JAM’D administered domains powered by SquareSpace, while no data is directly provided by you, I recommend reading the SquareSpace privacy policy, which can be found here.

As a Contact or Client, by contacting in a more personalized connection with JAM’D, you may provide information as outlined below:

  • Contact information (such as name, email, job title, organization, location, phone number, email, address, and country)

  • Marketing information (regarding your contact preferences)

  • Consultative services data (which is data you provide to determine scope of work, establish a quote, and move forward as a contracted client)

  • Organizational data collected for analysis (which is data you have collected on your clients / organization, which you have contracted JAM’D for services on)

  • Payment information (as processed by SquareSpace - Square (in-person payment transactions), Stripe (online Credit Card), or Paypal (online Paypal or Venmo))

By Vendors (for all entities)

  • Subscribers, Visitors, Contacts, and Clients are all subject to the Privacy Policies for noted vendors.  Please review the necessary policies as laid out in the “Vendors” section.

  • Please Note: This does include Service Usage Data (through analytic cookies), providing JAM’D with data on website usage.  This data is collected via SquareSpace Cookies policies. Please review their Cookie policies accordingly. Data points consumed by JAM’D within the service provider’s data infrastructure are listed below:

    • Device Specifications (operating system, mobile / desktop)

    • Browser Information (e.g., Chrome, Safari, etc)

    • Referral Information (e.g., direct link, search engine)

    • IP Address

    • Website activity (including date/time, pages viewed, internal site searches) 

Information collected from other sources:

Through preparation techniques to render services to Contacts or Clients, I may collect data from social media platforms, public websites, third-party data providers, or public databases.

This data would be limited to organizational information (such as mission statements, location, and grant eligibility information).  This information will be used to quote services to Contacts and / or render services agreed-upon to Clients

JAM’D will not collect data from these other sources around individuals’ demographics or online behavioral data. 

How I Use Your Data 

Subscriber data is used strictly by JAM’D to personalize email campaigns based on the Subscriber’s marketing preferences.  At any time, the Subscriber can unsubscribe from some or all email correspondence powered by SquareSpace and / or by direct contact with JAM’D.

Visitor data is used by JAM’D strictly to validate the site has visitors now-and-again and to analyze popular blog posts versus unpopular blog posts.  All Visitor data is stored and managed by SquareSpace, subject to their Privacy Policy.

Contact data is used by JAM’D for tracking the life cycle from quote to sale.  If a Contact declines to enter a contract-bound relationship as a Client, the Contact may request a “do not contact” status, which retains only enough information to prevent JAM’D from future contacts (namely, name, organization, and email).  Once determined a Contact will not be moving forward as a Client, organizational data provided for analysis will be permanently deleted within 30 calendar days from the JAM’D hardware.  JAM’D reserves the right to retain correspondence notes and contact information for future context in the event the Contact requests future service.

Client data is used by JAM’D to render services, communicate status updates, bill for agreed-upon services, and provide information to attorneys and accountants to meet legal and accounting requirements in accordance with legitimate business interests.  Data analytics around JAM’D productivity will also be performed using service and product-level detail information.  At the completion of the contract period and once a Client is paid in full for all services rendered, the Client may request a “do not contact” status, which retains only enough information to prevent JAM’D from future contacts (namely, name, organization, and email).  Organizational data provided for analysis will be permanently deleted within 30 calendar days from the JAM’D hardware at the conclusion of all contracts, unless explicitly determined otherwise and communicated in writing from the Client.  JAM’D reserves the right to retain correspondence notes and contact information for future context in the event the Client requests further service.

My Security

JAM’D takes appropriate and reasonable technical and organizational measures designed to protect your information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of any personal information. If you have any questions around security, please contact JAM’D directly.

While data may transfer when using a Service Provider (see list below) for email campaigns, website consumption, email, or billing, each vendor is compliant with Privacy Shield and GDPR protection clauses, as laid out in their individual privacy policies.

Data Retention

JAM’D retains data as long as there is an ongoing legitimate business or legal need to do so.  Generally, retention periods are outlined below (unless previously agreed-upon in writing):

  • Organizational data provided as part of a service rendered (i.e. data collected by a Client on their services, organization, or clients) will be destructed within 30 days of contract completion and payment in full.

  • Contacts or Clients requesting a “do not contact” status will require enough data be stored indefinitely to ensure JAM’D does not contact them inadvertently (name, email, organization name, general correspondence data from prior interactions).  All other data will be destructed within 30 days of written request.

  • Subscribers and Visitors are subject to third-party vendor privacy policies only and no data is directly stored by JAM’D, and no data retention policy is required.

Your rights

You have the right, not just legally, but as a human:

  • To access, correct, update, port, delete, restrict, or object to my processing of your information. For help updating your subscription status or contact preferences at any time, contact JAM’D directly.

  • The right to complain to a data protection authority.  To do so, contact your local data protection authority.

  • To not be discriminated against, both for complaints regarding the privacy policy, how your information / data is used, or as a human. 

  • Ask me, at any time.  You can reach JAM’D at the above and below contact information.

Other Miscellaneous Data Points

Blog comments: any information you include as a comment on any blog on the JAM’D website may be read, collected, or used by anyone.  If you want a comment removed, contact JAM’D directly.  If I am unable to remove it, I will explain.

Social media widgets:  the JAM’D website may contain social media features, such as a “Like” button.  These features are hosted by a third-party, governed by the third-party owner’s privacy policy.  Any communications with JAM’D or materials submitted via the social media features or on the social media platforms is done at your own risk without any expectation for privacy.  JAM’D cannot control the actions of the other users of these platforms or the actions of the social media platforms themselves. 

Third-party websites: Occasionally the JAM’D site will reference third-party, external websites.  Any information provided once a Visitor has followed that link is governed by the external website’s privacy policy.  I encourage you to review their policies as you see fit.

Promotions: From time to time, JAM’D may send surveys or contests (“Promotions”) through email or social media.  Participation is completely voluntary and information requested for entry may include information such as name, address, email, phone number, or similar details.  This information is strictly used for Promotions, and unless prohibited by law, to communicate with you about services.  

How I Share Information

I may share your information with third party vendors as described below:

  • Service Providers: JAM’D may need to share your information with a vendor as described above in the “How I Use Your Data” section.  Sharing of information is limited to minimal required data to perform the task, such as delivering content, email campaigns, or billing.  For a full list of Service Providers and links to their Privacy Policies, please see below.

  • Any competent law enforcement body, regulatory body, government agency, court or other third party where disclosure is necessary as a matter of

  • applicable law or regulation

  • to exercise, establish, or defend my legal rights

  • to protect your vital interests or those of any other person.

I will not share your information with advertising partners.

  • GSuite  is my email, scheduler, calendar, and video call provider

Clients

  • Google Drive is used for foundational operations. 

  • Microsoft Office 365 and OneDrive (deprecated as of April 2021) is used for foundational operations.  No organizational data will be stored on OneDrive unless permission is given explicitly and in writing for the purposes of sharing back and forth when email is not adequate.

  • Tableau Public (only when explicitly discussed and agreed upon in writing)

  • PowerBI (deprecated as of April 2021, desktop version only, unless explicitly discussed and agreed upon in writing)
